Affiliate programme terms

These terms govern the CVD Portal affiliate programme, operated by Porta Regulus B.V., registered in the Netherlands (KvK 42062307, VAT NL869534208B01). You accept them when you apply. We may change them, and material changes require you to accept a new version before further bounties accrue.

1. What this is

You refer prospective customers to CVD Portal and we pay you a flat bounty when one takes a paid subscription. You are an independent contractor. This creates no partnership, agency, employment, or authority to bind us to anything.

This is not a reseller agreement. You do not resell, sublicense, set prices, hold customer data, or get access to a customer's workspace. If you need those, the partner programme is a separate arrangement.

2. Eligibility

Anyone may apply. We approve applications at our discretion and may decline or later withdraw approval without giving a reason. Holding a current Partner Academy certification is optional and counts in your favour, since it evidences that you can describe the regulation accurately.

3. Attribution

  • Following your referral link sets a first-party cookie that lasts 90 days. A signup within that window is attributed to you.
  • Attribution is last-touch. If a visitor later follows a different affiliate's link before signing up, that affiliate is credited.
  • Attribution happens once, when the account is first created. An account that already exists is never re-attributed.
  • A company onboarded by a reseller partner earns no affiliate bounty. The reseller relationship takes precedence.
  • You cannot refer yourself, your own employer, or any company sharing your email domain.

4. Bounties

One bounty per referred company, on their first paid subscription. Current rates:

  • Reporting — €150
  • Compliance — €500
  • Enterprise — €2,000

The bounty is fixed at the tier and rate in force when the subscription starts. If we change the rates afterwards, bounties already earned are unaffected. A later upgrade does not create a second bounty.

5. Clearance and payment

  • A bounty clears 30 days after the subscription starts. If the customer cancels, refunds, or charges back within that window, the bounty is void.
  • Once cleared, a bounty is owed and is not clawed back if the customer later churns.
  • We email a statement of cleared, unpaid bounties. You invoice us from the billing entity on your application, and we pay by bank transfer within 30 days.
  • You are responsible for your own tax and VAT position, including whether reverse charge applies. We do not withhold or calculate tax for you.
  • Bounties are payable in euro. Bank charges and currency conversion are yours.

6. Prohibited practices

Any of these voids affected bounties and may end your participation.

  • Stating or implying that CVD Portal, or any product, guarantees CRA compliance, certifies conformity, or removes the manufacturer's own legal responsibility. It does none of those things.
  • Claiming to be, or to act on behalf of, Porta Regulus B.V., CVD Portal, the European Union, ENISA, a notified body, or a market surveillance authority.
  • Bidding on our brand terms or close variants in paid search, or running ads that use our name in the display URL or headline.
  • Listing the programme on coupon, deal, or cashback sites, or offering unauthorised discounts.
  • Unsolicited email, SMS, or messaging. Every recipient must have a lawful basis you can evidence.
  • Cookie stuffing, typosquatting, forced clicks, or any attribution not resulting from a deliberate click by a real person.
  • Failing to disclose that your link is a paid referral, where the platform or applicable law requires it.
  • Registering domains, social accounts, or app listings containing our name or marks.

7. Use of our name and materials

You may describe the product accurately and use our name in plain text to identify it. You may not modify our logo, imply endorsement of your own services, or copy our marketing claims into contexts that change their meaning. We can ask you to correct or remove any specific use.

You are an affiliate, and not a partner. "Partner" is reserved for organisations that have signed a partner agreement and operate client workspaces on our platform. You may not describe yourself as a CVD Portal or CVD Portal partner, say that you have partnered with us, or call yourself an official or authorised reseller. Someone making a compliance purchase reads those words as a vetted commercial relationship, and for an affiliate that is not what exists.

Accurate descriptions include "CVD Portal affiliate", "I recommend CVD Portal", and "I earn a commission if you sign up through this link". If you hold a Partner Academy certificate you may state that you are a Certified Partner Consultant, because that is the credential's name and it certifies you personally. It does not make your business a partner.

8. Data protection

Each of us is an independent controller for the personal data we hold. If you send us personal data about a prospect, you confirm you have a lawful basis to do so. We process the personal data you give us as described in our privacy notice.

9. Term and termination

Either of us may end this arrangement at any time, for any reason, on written notice. On termination your link stops attributing immediately. Bounties that have already cleared remain payable. Bounties still inside the clearance window are void if we terminated you for a breach of section 6, and otherwise clear normally.

10. Liability and governing law

Nothing here excludes liability that cannot lawfully be excluded. Otherwise our total liability to you is limited to the bounties payable to you in the twelve months before the claim. These terms are governed by the laws of the Netherlands, and the competent court in Amsterdam, the Netherlands, has exclusive jurisdiction.
